Welcome to AthletiXPhysio, operated by FUTUREWAVE SOLUTIONS LIMITED, a company registered in Hong Kong. Throughout these Terms, “we,” “us,” and “our” refer to AthletiXPhysio and its operator.
Our website, online store, products, content, features, and associated services are collectively referred to as the “Services.”
We use Shopify to provide the ecommerce platform supporting our store, checkout, and related functionality.
These Terms of Service, together with our Privacy Policy, Shipping Policy, and Return and Refund Policy, explain the conditions that apply when you use our Services or purchase from us.
By using the Services, you agree to these Terms. If you do not agree, please discontinue use of the Services. Nothing in these Terms removes rights that cannot be waived under applicable law.
SECTION 1 - ACCESS AND ACCOUNT
You must be at least the age of majority in your place of residence to place an order or create an account.
When purchasing or using account features, you agree to provide accurate, complete, and current information, including your contact details, billing address, delivery address, and payment information.
Where accounts are available, you are responsible for protecting your login credentials and for activity you authorize through your account. Please notify us promptly if you suspect unauthorized access.
SECTION 2 - OUR PRODUCTS
We aim to describe and display our products accurately. Colors and appearance may differ slightly because of screen settings, photography, lighting, or manufacturing variations. These variations do not excuse supplying an item that materially differs from its description.
We may revise product listings, change availability, limit quantities, or discontinue items. Changes do not retrospectively alter our obligations for accepted orders.
Our products are offered for general fitness, training, movement, and personal use. We do not market them as medical devices or as products intended to diagnose, treat, cure, or prevent diseases, injuries, or medical conditions.
Please follow all available instructions and safety information and use products within your individual ability and fitness level. Consult a qualified healthcare professional if you have concerns about suitability.
SECTION 3 - ORDERS
Submitting an order constitutes an offer to purchase the selected items. Orders are confirmed after payment has been successfully processed and we have sent an order confirmation.
Subject to applicable law, we may decline, limit, or cancel an order for reasons such as unavailable stock, pricing errors, payment problems, an undeliverable address, suspected fraud, or other legitimate operational issues.
If an issue affects your order, we will attempt to contact you using your checkout details. We will not substitute products or increase the agreed price without your consent. If we cancel an order after taking payment, we will refund the amount paid for the canceled items and any associated charges that are no longer applicable.
Purchases are intended for personal use, rather than unauthorized resale or commercial redistribution.
Return requests and refunds are governed by our Return and Refund Policy, including its 90-day return request window and eligibility requirements.
SECTION 4 - PRICES AND BILLING
Prices are shown in United States Dollars (USD) unless expressly stated otherwise.
The applicable purchase price is the amount presented at checkout when you submit your order. Any shipping charges, optional shipping upgrades, and applicable taxes are displayed before payment is completed.
Prices may change for future purchases. A later price change does not alter an order already accepted.
By submitting payment details, you confirm that you are authorized to use the selected payment method and authorize the charge of the total amount shown at checkout.
SECTION 5 - SHIPPING AND DELIVERY
We deliver within the United States only, subject to the restrictions in our Shipping Policy.
Order Cut-off Time: 12:00 PM Eastern Time (EST/EDT)
Processing Time: 0–2 business days
Orders are processed Monday through Friday, excluding public holidays. Orders placed after the cut-off are generally handled beginning on the next business day.
Delivery estimates include the processing and transit periods specified in our Shipping Policy. They are estimates rather than guaranteed arrival dates.
Carrier disruptions, severe weather, seasonal demand, address issues, or other operational circumstances may affect delivery. The carrier manages transportation after dispatch, but handover to the carrier does not remove our obligations under applicable law or our published policies.
Please contact us if your shipment is delayed, lost, or damaged so we can investigate and explain the available resolution.
SECTION 6 - INTELLECTUAL PROPERTY
The website’s text, images, graphics, branding, layouts, and original design elements belong to AthletiXPhysio, FUTUREWAVE SOLUTIONS LIMITED, or the relevant licensors and rights holders, as applicable.
You may access and use the Services for personal, non-commercial purposes. Unless permitted by law or authorized in writing by the relevant rights holder, you may not reproduce, modify, distribute, or commercially exploit protected website content.
Using the Services does not transfer ownership of any intellectual property to you.
SECTION 7 - OPTIONAL TOOLS
We may make independently operated third-party tools or features available through our Services.
Where permitted by law, these optional tools are supplied on an “as is” and “as available” basis, without additional warranties from us. Their use may be subject to the provider’s own terms.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
Shopify provides the ecommerce platform and infrastructure used to operate AthletiXPhysio.
Purchases from our store are transactions with FUTUREWAVE SOLUTIONS LIMITED, trading as AthletiXPhysio, rather than with Shopify.
We are responsible for handling inquiries about our products, orders, returns, refunds, and customer support. Shopify’s provision of platform services does not make Shopify the seller of our products or replace our responsibilities to you.
SECTION 10 - PRIVACY POLICY
Our collection, use, and disclosure of personal information are explained in our Privacy Policy.
Shopify and other providers may process information to support checkout, payments, analytics, advertising, shipping, customer support, and other store functions.
Please review the Privacy Policy for details about data handling and available privacy choices. Agreement to these Terms does not substitute for consent where separate consent is required by law.
SECTION 11 - FEEDBACK
You may submit suggestions, reviews, comments, or other feedback about our store and products.
You retain ownership of your content. By submitting content for publication, you grant us a non-exclusive, royalty-free license to reproduce, display, and share it in connection with our store and its promotion, subject to applicable law and our Privacy Policy. Any additional charge or material order change requires your agreement. If an affected paid order is canceled, the applicable payment will be refunded.

Existing rights concerning paid orders, refunds, and applicable consumer protections remain unaffected.

To the extent permitted by law, the Services and products are provided on an “as is” and “as available” basis, except for express commitments in our listings and policies and any warranties or protections required by law.
We cannot guarantee that website access will always be uninterrupted, error-free, or free from security risks.
Individual preferences and results may vary. We do not promise that a product will suit every purpose or expectation, but this does not limit our responsibility to supply products that meet their description and any applicable legal requirements.

To the extent legally permitted, AthletiXPhysio and FUTUREWAVE SOLUTIONS LIMITED exclude liability for indirect, incidental, special, punitive, or consequential losses arising from use of the Services or products purchased through our store.
No provision excludes or limits liability where doing so is prohibited by law. Your mandatory consumer rights and our express obligations under published store policies continue to apply.

The remaining provisions will continue to apply, to the extent permitted by law.

They do not exclude express commitments made as part of an accepted order or representations and rights that cannot lawfully be excluded.
SECTION 20 - ASSIGNMENT
We may transfer rights or obligations, or subcontract operational tasks, where appropriate for legitimate business or legal purposes and permitted by law.
Such arrangements will not reduce your applicable consumer rights. Subcontracting services does not itself release us from our obligations to you.
You may not transfer your rights or obligations under these Terms without our prior written consent, except where applicable law permits otherwise.

These Terms are governed by the laws of Hong Kong, where FUTUREWAVE SOLUTIONS LIMITED is registered, subject to mandatory laws that apply to your purchase or use of the Services.
Customers in the United States retain any applicable rights under federal, state, and local consumer protection laws. This section does not override protections that cannot legally be waived.
SECTION 22 - CHANGES TO TERMS
We may revise these Terms to reflect changes in our operations, Services, or legal requirements.
Revisions will appear on this page with an updated “Last Updated” date. We will provide additional notice or obtain agreement where required by law.
Continued use after revised Terms take effect constitutes acceptance to the extent permitted by law. Updates do not retrospectively change the terms of orders already accepted, unless legally required or separately agreed.
